The US Commerce Department has found that critical circumstances exist for imports of hot rolled coil (HRC) from certain producers in Brazil and Japan, but not from producers in Australia and the Netherlands.
Brazilian steelmakers CSN and Usiminas and Japan's Nippon Steel & Sumitomo Metal Corp (NSSMC) and JFE Steel now face the prospect of backdated duties.
The findings were based on a comparison of US imports from the producers between June and October to imports between January and May.
Typically, critical circumstance determinations compare shipments made during the three months before and after the filing of a petition, which, in this case, was August 11. However, trade press stories hinting at an HRC case led to the unusual timeline, according to the US Commerce Department.
